Terms of Use for Sharemy

Please read these Terms of Use ("Terms") carefully before using the Sharemy web application (the "Service") operated by Sagar Kumbhar ("us", "we", or "our").
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.
1. Description of Service
Sharemy provides a free-to-use platform for peer-to-peer (P2P) file sharing. The Service allows users to connect directly with other users in private "rooms" to transfer files. The files are transferred directly between user devices and are not stored on our servers.
2. User Conduct and Responsibilities
You are solely responsible for your conduct and the content of the files you share while using the Service. By using the Service, you agree that you will not:
- Share any files that are unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
- Share any files that infringe upon any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
- Share any material that contains software viruses, malware, or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware.
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
You acknowledge that we do not pre-screen files, but we reserve the right (but not the obligation) to refuse or remove any user from the Service or terminate a session for violating these Terms.
3. Eligibility and Age Requirement
The Service is intended solely for users who are eighteen (18) years of age or older. Any access to, or use of, the Service by anyone under 18 is expressly prohibited.
By accessing or using the Service, you represent and warrant that you are 18 or older and have the full right, authority, and capacity to enter into this agreement and to abide by all of the terms and conditions of these Terms. If we become aware that a user is under the age of 18, we reserve the right to terminate their access to the Service immediately and without notice.
4. File Sharing
You are entirely responsible for the files you choose to share and receive. The Service includes features where a receiver must explicitly allow a file transfer before it begins. We strongly advise you to only accept files from users you know and trust. We are not responsible for the content or nature of any files transferred through the Service.
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Sagar Kumbhar. The Service is protected by copyright, trademark, and other laws of India and foreign countries. You retain all ownership rights to the files you transfer using the Service.
6. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
We do not warrant that:
- The Service will function uninterrupted, secure, or available at any particular time or location.
- Any errors or defects will be corrected.
- File transfers will always be successful. Unstable network conditions or browser limitations may cause transfers to fail, particularly for large files.
7. Limitation of Liability
In no event shall Sagar Kumbhar, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of data, loss of profits, or other intangible losses, resulting from:
- (i) your access to or use of or inability to access or use the Service;
- (ii) any content of any files transferred through the Service;
- (iii) any conduct of any third party on the Service;
- (iv) unauthorized access, use, or alteration of your transmissions.
You expressly agree that we are not responsible for any loss or damage to your data, computer system, or any other device resulting from the use of the Service.
8. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
10. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
